Terms of Service

01Who can use the Service

The Service is a business tool for painting contractors and related businesses. You must be at least 18 years old and able to enter a contract. If you use the Service for a company, you represent that you are authorized to bind that company.

02What the Service does

PaintingEstimate helps users create painting estimates from job photos and a written or spoken description. The Service may include account profiles, estimate drafting, line-item editing, Good / Better / Best options, estimate history, and PDF export.

The Service does not perform the painting work, verify job-site measurements, collect deposits from homeowners, or replace your professional judgment.

03AI estimates are drafts

Any estimate generated by the Service is a draft. AI can misread photos, miss surfaces, guess square footage incorrectly, or suggest labor and material amounts that do not match the job.

You are responsible for reviewing and correcting every estimate before you send it, including:

• Square footage and scope
• Surfaces, prep, coats, and materials
• Labor hours and rates
• Markup and totals
• Terms shown to the customer

If you send an estimate, that quote is yours. We are not a party to the job and are not responsible for underbidding, overbidding, missed work, or disputes with your customers.

04No legal, tax, or licensing advice

The Service is software, not a law firm, accountant, or licensing service. Any default terms, deposit language, or document text is for convenience only. You are responsible for licenses, insurance, permits, contracts, taxes, and compliance in your area.

05Accounts

You must provide accurate account information and keep your login secure. You are responsible for activity under your account. Notify us at csm@localhomeestimates.com if you think someone else is using it.

We may suspend or close an account if you break these Terms, misuse the Service, fail to pay a fee when billing is enabled, or create risk for us or other users.

06Plans and payments

The Service may include a Free plan and a paid Pro plan. Current prices are shown on the website and may change.

If you buy a paid plan:

• Payments are processed by Stripe
• Subscriptions renew until you cancel
• You can cancel at any time; access continues through the end of the current billing period
• Fees already paid are generally not refundable except where required by law or where we agree in writing

You are responsible for taxes on your subscription and on work you sell to your own customers.

07Your content

You own the photos, descriptions, customer details, estimates, and other content you upload or create (“Your Content”).

You grant us a limited license to host, store, process, display, and export Your Content only as needed to operate the Service. That includes sending photos and descriptions to third-party AI providers to generate a draft estimate.

You represent that you have the right to upload Your Content and that it does not violate anyone else’s rights.

We own the Service, including the website, software, design, prompts, and default estimating logic.

08Acceptable use

You may not:

• Create fake or misleading estimates
• Impersonate another contractor or company
• Upload content you do not have the right to use
• Try to break, scrape, or reverse engineer the Service
• Use the Service to build a competing product
• Violate any law
• Abuse the AI features with automated bulk generation

09Privacy

Our Privacy Policy explains how we collect and use information. By using the Service, you also agree to that policy.

10Disclaimer

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DO NOT WARRANT THAT ESTIMATES, MEASUREMENTS, QUANTITIES, OR TOTALS WILL BE ACCURATE, COMPLETE, OR FIT FOR A PARTICULAR JOB. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.

11Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOCAL HOME ESTIMATES, LLC IS NOT LIABLE FOR LOST PROFITS, LOST JOBS, INCORRECT ESTIMATES, CUSTOMER DISPUTES, DATA LOSS, OR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR $50.

12Indemnification

You will defend and hold harmless Local Home Estimates, LLC from claims arising out of Your Content, estimates you send, work you perform, your customer relationships, or your misuse of the Service.

13Termination

You may stop using the Service and request account deletion by emailing csm@localhomeestimates.com. We may keep information as described in the Privacy Policy or as required by law.

14Changes

We may update these Terms. The effective date at the top will change when we do. If a change is material, we will provide notice when appropriate. Continued use after the update means you accept the revised Terms.

15Governing law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Courts located in Miami-Dade County, Florida will have jurisdiction, except where applicable law requires otherwise.
